By browsing this website, purchasing a plan, downloading files, requesting customization, creating an account, submitting information, or using any Akashi Designs product or service, you agree to these Terms & Conditions.

If you do not agree with these Terms & Conditions, you should not use this website, submit information, purchase a plan, download files, or request services from Akashi Designs.

2. Digital Products

House plans sold through Akashi Designs are digital products. After successful payment confirmation, the buyer receives access to the applicable digital plan files through a secure delivery link, email guidance, or another approved digital delivery method.

Digital plan packages may include architectural drawings, floor plans, elevations, roof plans, 3D views, schedules, presentation images, plan previews, and other documents depending on the plan package purchased.

The exact files included may vary from plan to plan. Buyers should review the plan description and contact Akashi Designs before purchase if they require a specific file type, drawing, format, scale, measurement system, or approval document.

3. Age, Authority, and Buyer Responsibility

By using this website or purchasing from Akashi Designs, you confirm that you have the legal capacity and authority to enter into this agreement and to make the purchase or request on behalf of yourself, your household, your business, or your project.

If you are purchasing on behalf of another person, business, developer, contractor, or organization, you confirm that you have authority to bind that person or entity to these Terms & Conditions.

Buyers are responsible for reviewing the selected plan ID, style, specifications, file expectations, local suitability, and checkout details before completing payment.

4. License to Use Purchased Plans

A purchased plan grants the buyer a limited, non-exclusive, non-transferable license to use the plan for personal residential construction planning, subject to the applicable licensing terms.

Unless expressly agreed in writing, each plan purchase is licensed for one project or one build only.

The buyer may share the plan files with their builder, contractor, engineer, local architect, quantity surveyor, approval consultant, or relevant authority only for the purpose of adapting, reviewing, approving, pricing, or constructing the buyer’s licensed project.

5. Restrictions on Use

Purchased plans may not be resold, redistributed, uploaded to other websites, shared publicly, copied for commercial resale, converted into a competing product, used as a lead magnet, included in another plan catalogue, or used to create multiple builds without written permission from Akashi Designs.

Buyers may not claim Akashi Designs plans as their own original work or remove ownership, copyright, watermark, attribution, file labels, licensing notes, or other proprietary information from plan files, images, previews, or documents.

Any unauthorized copying, resale, mass sharing, commercial reuse, or misuse of Akashi Designs plan files may result in termination of access, cancellation of license rights, takedown requests, legal action, and claims for damages.

6. Website Use Rules

You agree to use this website only for lawful purposes and in a manner that does not violate the rights of Akashi Designs, other users, customers, service providers, or third parties.

You may not upload, transmit, submit, or send harmful files, malware, viruses, corrupted data, unlawful material, defamatory material, abusive content, spam, chain messages, unauthorized advertising, or content that infringes another person’s rights.

You may not use any device, software, script, routine, or process that interferes with the proper functioning, security, speed, reliability, or availability of the website.

You may not take any action that places an unreasonable or disproportionately large load on Akashi Designs’ website, servers, infrastructure, payment flow, download system, or support channels.

8. Account and Checkout Information

You agree to provide true, accurate, current, and complete information when contacting Akashi Designs, submitting forms, requesting customization, creating an account, or completing checkout.

If the information provided is false, incomplete, outdated, suspicious, or appears to be connected to fraud, chargeback abuse, unauthorized use, or misuse of digital files, Akashi Designs may delay delivery, request verification, suspend access, cancel an order, or refuse future service.

You are responsible for keeping your account details, download links, email account, order details, passwords, and devices secure.

9. Accuracy of Plan Information

Akashi Designs aims to present accurate plan descriptions, images, prices, dimensions, specifications, features, file notes, and product information. However, errors, omissions, updates, variations, or typographical mistakes may occur.

Images, renders, videos, furniture, landscaping, décor, lighting, finishes, appliances, materials, and presentation visuals may be for illustration and marketing purposes only and may not form part of the construction package unless expressly stated.

Drawings, diagrams, preview images, and website images may not be to scale. Buyers should not rely on marketing previews as final construction documents.

All specifications, availability, plan details, prices, and file contents are subject to change without notice. Buyers should confirm any critical feature, file type, dimension, or specification before purchase where it is essential to their project.

10. Local Approval, Engineering, and Compliance

Akashi Designs plan packages are design products and may require review, adaptation, engineering, stamping, structural calculations, energy calculations, site planning, or approval by licensed professionals in the buyer’s location before construction.

Building codes, planning rules, zoning requirements, soil conditions, climate requirements, structural standards, fire safety rules, accessibility requirements, and authority approval processes vary by location.

The buyer is responsible for confirming that the purchased plan is suitable for their land, local authority requirements, construction method, intended use, budget, and applicable laws before building.

Akashi Designs does not guarantee that a plan will be approved by any local authority, engineer, architect, planning office, homeowners association, or other approving body without modification or additional professional input.

11. Customization and Modifications

Akashi Designs may offer plan customization, layout adjustments, metric conversion, garage changes, porch changes, roof changes, exterior revisions, and related design support as separate services.

Customization requests are reviewed separately and may attract additional fees depending on the scope, complexity, urgency, and file requirements.

A customization request is not confirmed until Akashi Designs has reviewed the request and issued written confirmation, a quotation, an invoice, or a project instruction where applicable.

Modifying a purchased plan does not remove Akashi Designs’ copyright or licensing rights in the original design.

12. Payments and Checkout

Payments are processed through the checkout methods available on the website at the time of purchase.

Buyers must provide accurate billing, contact, and delivery information. Akashi Designs is not responsible for delivery delays caused by incorrect email addresses, incomplete buyer information, failed payment confirmation, payment provider delays, or buyer-side email filtering.

Prices may change without prior notice. A completed purchase is charged at the price shown at checkout at the time of payment.

Where a payment is flagged, disputed, reversed, cancelled, charged back, or suspected of fraud, Akashi Designs may suspend download access, pause delivery, request verification, cancel the license, or take other protective action.

13. Delivery and Download Access

Digital delivery is normally released after payment confirmation. Access may be provided through a secure download page, buyer email, or another approved delivery method.

The buyer is responsible for keeping their delivery link, invoice, and order information safe.

If a buyer experiences download problems after a confirmed payment, they should contact Akashi Designs support using the email address provided on the website.

Akashi Designs may revoke, limit, or deactivate download access where there is suspected fraud, refund approval, license breach, chargeback activity, unauthorized sharing, or misuse of files.

14. Refunds

Because house plans are digital products, refund eligibility is limited once files have been delivered, downloaded, accessed, emailed, or otherwise made available.

Refund requests are reviewed according to the Akashi Designs Refund Policy. Buyers should read the refund policy before completing checkout.

Where a refund is approved, Akashi Designs may revoke download access and terminate the license associated with that purchase.

Akashi Designs is not responsible for the content, privacy practices, security, availability, policies, errors, downtime, payment delays, or actions of third-party websites or service providers.

16. Submissions, Enquiries, and Customer Materials

If you submit ideas, comments, testimonials, reviews, plan notes, customization requests, sketches, reference images, project briefs, or other materials to Akashi Designs, you confirm that you have the right to share them.

You grant Akashi Designs permission to use those submissions as reasonably necessary to respond to your enquiry, prepare quotes, provide services, process orders, deliver customization, improve products, and support your project.

Unless expressly agreed in writing, unsolicited ideas, general suggestions, and feedback sent to Akashi Designs are not treated as confidential and may be used to improve Akashi Designs products, services, website content, and customer experience.

17. No Warranty

To the fullest extent permitted by law, the website, website content, digital plan files, previews, images, downloads, product information, customization support, and related services are provided on an “as is” and “as available” basis.

Akashi Designs does not guarantee that the website will be uninterrupted, error-free, virus-free, always secure, always available, or that defects will always be corrected immediately.

Akashi Designs does not warrant that any plan will meet every buyer expectation, local authority requirement, land condition, engineering requirement, construction budget, contractor preference, or intended use without adaptation or professional review.

18. Limitation of Liability

To the fullest extent permitted by law, Akashi Designs is not liable for indirect, incidental, special, punitive, consequential, or exemplary losses arising from website use, plan purchase, file delivery, download issues, construction decisions, contractor errors, local authority rejection, engineering requirements, project delays, lost profits, lost opportunity, data loss, or unauthorized access.

Akashi Designs is not responsible for construction errors, site conditions, contractor decisions, engineering decisions, local approval outcomes, authority rejection, material substitution, cost overruns, local law requirements, or unauthorized modifications made after purchase.

Where liability cannot be excluded, Akashi Designs’ total liability is limited, to the maximum extent permitted by law, to the amount paid by the buyer for the relevant digital product or service giving rise to the claim.

19. Indemnification

You agree to indemnify and hold Akashi Designs, its directors, team members, contractors, service providers, partners, and representatives harmless from claims, losses, damages, liabilities, costs, and expenses arising from your breach of these Terms & Conditions.

This includes claims connected to unauthorized sharing of plan files, misuse of designs, false submissions, unlawful website use, infringement of third-party rights, chargeback abuse, local construction decisions, or your failure to obtain proper professional review and approval.

20. Suspension and Termination

Akashi Designs may suspend or terminate access to downloads, accounts, checkout, support, customization services, or website features where it reasonably believes there has been fraud, abuse, unlawful activity, unauthorized sharing, copyright misuse, chargeback abuse, harmful conduct, or breach of these Terms & Conditions.

Suspension or termination does not limit Akashi Designs’ right to pursue payment, recover losses, enforce copyright, protect its systems, or seek legal remedies.

21. Notices and Communication

Akashi Designs may send notices, order confirmations, invoices, download links, refund updates, policy updates, and support communications by email or through the contact details provided by the buyer.

The buyer is responsible for providing and maintaining a correct email address and checking spam, junk, promotions, or filtered folders for messages related to their order.

23. General Provisions

These Terms & Conditions, together with the Privacy Policy, Refund Policy, and Copyright & Licensing Policy, form the main agreement between you and Akashi Designs for use of this website and purchase of digital house plan products.

If any part of these Terms & Conditions is found invalid, unlawful, or unenforceable, the remaining parts will continue to apply to the fullest extent permitted by law.

Failure by Akashi Designs to enforce any right immediately does not waive that right.

Any rights not expressly granted to the buyer are reserved by Akashi Designs.
